Waiver
It is the contractor’s responsibility to pay laborers
and subcontractors promptly. However
a big problem can arise if the contractor does not pay
their subcontractor. This situation can result in
the property owner being forced to pay the same bill twice.
Solution: Require the contractor to get lien waivers from
all subcontractors before the final payment is made. Many
states require that a lien waiver be in
writing to be enforceable. If this is not your state,
it is still important to get a written lien waiver. Without
it there is no evidence of the waiver.
